Inconstitucionalidad del art. 22 de la ley de caminos.

Resumen
The Art. 173 of this Constitution of the Republic of the Ecuador send that, the
administrative acts of any authority of the State will be able to be refuted, so
much in the administrative road as before the corresponding organs of the
Judicial Function; in such a way that should necessarily have act, fact or
administrative contract emitted by administrative authority so that those
administered can refute it before the respective Tribunal Administrative
Distrital of the Contentious thing, should make it from the following day of the
notification and inside the term or term settled down in the Art. 65 of the Law
of the Administrative Contentious Jurisdiction so that it doesn't operate the
expiration.
In yes, what characterizes to the action contentious office worker is the
resolution of conflicts between the Public Administration and the matters,
occasionally among entities of the same public administration. Therefore,
some of the parts, the actor or the defendant should be obligatorily a public
entity.
The Art. 22 of the Law of Roads order that, the litigations related with public
roads that are not attributed to another authority by this law, will be known by
the judges of the contentious office worker of the place where the public road
is located; he/she refers in opinions of public roads for disputes of public
roads of horseshoe, of private roads of use public and of private roads; it is
not refuted act, fact or administrative contract some and none of the parts is
public entity so that it is administrative contentious action and for ende of the
administrative judge’s of the contentious thing competition.
Nevertheless the clarity of the nature of the administrative contentious action,
the Art. 22 of the Law of Roads seek that the Contentious Office worker's
Tribunals solve problems of roads that are conflicts among matters; for the
actor the road is public, while for the defendant it is deprived and the litis is
begun this way.
At any rate it is a conflict among particular and therefore of civil nature, the
civil judge’s competition.
consider that the trials of public roads should be processed before the
judges of the civil thing so that you offers an administration of agile and
opportune justice; and, be fulfilled the principles of velocity and effectiveness.
In my approach, in the form like the Art is conceived. 22 of the Law of Roads
are unconstitutional, since it contradicts the Art. 173 of the Constitution of the
Republic of the Ecuador. El Art. 173 de esta Constitución de la Republica del Ecuador manda que, los
actos administrativos de cualquier autoridad del Estado podrán ser
impugnados, tanto en la vía administrativa como ante los correspondientes
órganos de la Función Judicial; de tal manera, que necesariamente debe
haber acto, hecho o contrato administrativo emitido por autoridad
administrativa para que los administrados puedan impugnarlo ante el
respectivo Tribunal Distrital de lo Contencioso Administrativo, debiendo
hacerlo desde el siguiente día de la notificación y dentro del término o plazo
establecido en el Art. 65 de la Ley de la Jurisdicción Contenciosa
Administrativa para que no opere la caducidad.
En sí, lo que caracteriza a la acción contenciosa administrativa es la
resolución de conflictos entre la Administración Pública y los particulares,
ocasionalmente entre entidades de la misma administración pública. Por lo
tanto, unas de las partes, el actor o el demandado debe ser obligatoriamente
una entidad pública.
El Art. 22 de la Ley de Caminos ordena que, los litigios relacionados con
caminos públicos, que por esta ley no estén atribuidos a otra autoridad,
serán conocidos por los jueces de lo contencioso administrativo del lugar
donde está ubicado el camino público; se refiere a juicios de caminos
públicos por disputas de caminos públicos de herradura, de caminos
privados de uso público y de caminos privados; no se impugna acto, hecho o
contrato administrativo alguno y ninguna de las partes es entidad pública
para que sea acción contenciosa administrativa y por ende de competencia
de los jueces de lo contencioso administrativo.
No obstante la claridad de la naturaleza de la acción contencioso
administrativa, el Art. 22 de la Ley de Caminos pretende que los Tribunales
de lo Contencioso Administrativo resuelvan problemas de caminos que son
conflictos entre particulares; para el actor el camino es público, mientras que
para el demandado es privado y así se traba la litis.
De cualquier modo es un conflicto entre particulares y por lo tanto de
naturaleza civil, competencia de los jueces civiles.
Considero que los juicios de caminos públicos deben tramitarse ante los
jueces de lo civil para que se brinde una administración de justicia ágil y
oportuna; y, se cumpla con los principios de celeridad y eficacia.
En mi criterio, en la forma como está concebido el Art. 22 de la Ley de
Caminos es inconstitucional, por cuanto contradice al Art. 173 de la
Constitución de la República del Ecuador.
