El requerimiento de incautación judicial de bienes muebles afectados con garantía mobiliaria y su vía procedimental

Resumen
Nuestra Constitución en su artículo 139° inciso 3) instituye el derecho al debido proceso y
la tutela jurisdiccional; razón por la que los jueces, tienen el deber sustanciar los procesos
judiciales satisfaciendo dichas garantías, sin embargo, muchas veces se ven en dificultades
cuando se encuentran con normas que denotan un alto grado de ambigüedad. Es el caso del
artículo 56° del Decreto Legislativo 1400 – Ley de Garantía Mobiliaria, que al regular la
vía procedimental de los requerimientos de incautación de bienes muebles señala que será
en la “vía del proceso sumarísimo”, aunque seguidamente, precisa que el juez “sin mayor
trámite” dispondrá la incautación. Es en este contexto de notoria ambigüedad normativa,
casi contradictoria, que se gesta la necesidad de la presente investigación, a efecto de
establecer cuál es realmente la vía procedimental que instituye nuestro ordenamiento
jurídico, es decir evaluar si se trata de un proceso cognitivo, conforme al previsto en el
artículo 554° del CPC sometiendo a contradictorio el requerimiento, o se trata de una vía
especial, en el que se prevé reglas procedimentales específicas para su calificación, trámite
y ejecución.
Para lograr ese propósito la investigación se dividió en dos partes: Teórica, con el objeto de
efectuar una evaluación doctrinaria y normativa; y de campo, en el que se acopiaron y
estudiaron 08 expedientes judiciales; y además se efectuó una encuesta a todos los jueces
del módulo de justicia civil de la provincia Del Santa; y el estudio de la información se
efectuó en base a los métodos inductivo, descriptivo, analítico y comparativo; información
que se estructuró en tablas y cuadros; todo ello me ha permitido arribar a importantes
conclusiones: La principal, que el artículo 56° del DL 1400 regula una vía especial;
quedado demostrada la alta eficacia del procedimiento cuando se sustancian bajo reglas
específicas distintas a la previstas en el artículo 554° del CPC evitando someter al
contradictorio los requerimiento de incautación, pero garantizando a los justiciables el
derecho a la doble instancia. Our Constitution in its article 139 subsection 3) establishes the right to due process and

satisfying said guarantees, however, they often find themselves in difficulties when they
encounter norms that denote a high degree of ambiguity. This is the case of article 56 of
Legislative Decree 1400 - Movable Security Law, which when regulating the procedural
route of the requirements for the seizure of movable property indicates that it will be in the
"route of the summary process", although then, it specifies that the judge "Without further
processing" will order the seizure. It is in this context of notorious normative ambiguity,
almost contradictory, that the need for this research is born, in order to establish what is
really the procedural path that our legal system institutes, that is, to assess whether it is a
cognitive process, according to to that provided for in article 554 of the CPC, submitting
the requirement to contradictory, or it is a special route, which provides specific procedural
rules for its qualification, processing and execution.
To achieve this purpose, the investigation was divided into two parts: Theoretical, in order
to carry out a doctrinal and normative evaluation; and field, in which 08 judicial files were
collected and studied; Furthermore, a survey was carried out among all the judges of the
civil justice module of the Del Santa province; and the study of the information was carried
out based on inductive, descriptive, analytical and comparative methods; information that
was structured in tables and tables; All this has allowed me to reach important conclusions:
The main one, that article 56 of DL 1400 regulates a special route; The high efficiency of
the procedure has been demonstrated when they are carried out under specific rules other
than those provided for in Article 554 of the CPC, avoiding submitting the seizure
requirements to the contradictory party, but guaranteeing the right to double instance for
the defendants.
