Civil liability in air transport has been the response to a fact adversely affecting both people involved in this type of transport and people unrelated to it, as its goal is to repair the damage arising from the use of air transport, which makes the operator compensate the injured party. In this sense, civil liability in transport arises as a consequence of non-compliance or reasons unrelated to the parties (act of God, major force) originating the damage.La responsabilidad civil en el transporte aéreo ha sido la respuesta a un hecho que afecta desfavorablemente a personas involucradas en el transporte, como a personas ajenas al mismo y cuya finalidad es reparar el daño causado, el cual surge de la utilización del transporte aéreo, el cual obliga al transportista a indemnizar a la parte afectada. En ese sentido, la responsabilidad civil en el transporte surge como consecuencia de un incumplimiento o por causas ajenas a las partes (caso fortuito, fuerza mayor) de la que se derivan daños.
