dc.descriptionThe present investigation on the evaluation of the evidence in the accusatory criminal process, obeys to the importance that implies that the judges acquire security to condemn or acquit the persons accused of a criminal act. Intellectual activity that judges must perform, taking as premises, what is established in Article 20 section A fraction ll, of the Political Constitution of the United States of Mexico, which states that the tests will be assessed in a free and logical manner , in such a way that to sustain a conviction, the level of conviction of the judge, must exceed the standard of proof beyond any reasonable doubt to subsequently motivate and justify his decision according to a Constitutional Law State.
dc.descriptionLa presente investigación sobre la valoración de la prueba en el proceso penal acusatorio, obedece a la importancia que implica que los juzgadores adquieran seguridad para condenar o absolver a las personas acusadas de un hecho delictivo. Actividad intelectual que deben de realizar los jueces, tomando como premisas, lo establecido en el artículo 20 apartado A fracción ll, de la Constitución Política de los Estados Unidos Mexicanos, en el cual, se indica que las pruebas serán valoradas de forma libre y lógica, de tal manera que para sustentar una condena, el nivel de convicción del juzgador, deberá superar el estándar de prueba más allá de toda duda razonable para posteriormente motivar y justificar su decisión conforme a un Estado de Derecho Constitucional.
