| dc.description | Anticipatory sentences are an instrument for the immediate protection of fundamental rights, because the process can be decided before a substantive decision is reached. It is worth mentioning that they provide early justice by taking into account various characteristics concerning the process and that undoubtedly have as their purpose the protection of rights, through an early decision, total or partial on the required matter, either avoiding or restraining a greater danger. In addition to the antecedents of anticipatory judgments, some elements inherent to them are explained, such as due process and procedural principles, judgments and their principles, as well as the relationship with effective judicial protection and access to prompt justice. | |
| dc.description | Las sentencias anticipatorias, son un instrumento de protección inmediata de derechos fundamentales, debido a que puede decidirse sobre el proceso antes de llegar a resolver de fondo. Es de mencionar, que proporcionan una justicia temprana, esto al tomar en cuenta diversas características concernientes al proceso y que sin lugar a dudas, tienen como propósito la protección de derechos, a través de una decisión pronta, total o parcial sobre el asunto requerido, ya sea evitando o frenando un peligro mayor. Además de los antecedentes de las sentencias anticipatorias, se explican algunos elementos inherentes a estas, como son el debido proceso y los principios procesales las sentencias y sus principios así como la relación con la tutela judicial efectiva y el acceso a una justicia pronta. | |
