dc.descriptionAs a result of the transition presented in the Mexican penal system, as a product of the constitutional reform of June 18, 2008, it is convenient to understand the philosophical foundations on which the mixed inquisitorial system that is left and the accusatory system that is adopted is based. That is why it is important to contrast the secrecy that prevails in the first with the transparency that promises the second and, in the same way, it is pertinent to emphasize the presumption of guilt that characterizes the inquisitive system with the right to the presumption of innocence, which has as basic foundation the accusatory system.
dc.descriptionA raíz de la transición que sé está presentado en el sistema penal mexicano, como producto de la reforma constitucional del 18 junio 2008, resulta conveniente entender los fundamentos filosóficos sobre los cuales se sustenta el sistema inquisitivo mixto que sé deja y el sistema acusatorio que se adopta. Por ello es relevante contrastar el secretismo que impera en el primero con la transparencia que promete el segundo y, del mismo modo, pertinente es destacar la presunción de culpabilidad que caracteriza al sistema inquisitivo con el derecho a la presunción de inocencia, que tiene como fundamento básico el sistema acusatorio.
