Soberanía y constitucionalismo en América Latina: tendencias emergentes de la soberanía y el derecho internacional comunitario

The Philosophy of the State and its classical constitutive dimensionality is based on three principles: territorial jurisdiction, governance and population. Today sovereignty is another element of sovereign power, sovereign autonomy and self-determination of constitutional status and identity of the state. Globalization, as a phenomenon, emerges breaking those constitutional elements of the classical and contemporary philosophy of the state. Globalization expands as a transnational power, getting into laws and local sovereignty and further establishing a new order through supranational global instruments and free trade agreements. The economic system of Latin American countries and their constitutionalism subdues the emerging global hegemony that transcends sovereignty as a supranational sovereignty. This new transnational order lessens sovereign philosophical principles that gradually fade to undergo such contractual supranational jurisdictions gravitating in that pernicious foreign interference by the local constitutionalism. The dilemma lies in refuting that foreign law and, in avoiding such metamorphosis of sovereignty which was pointed out by Aristotle: "The sovereignty must belong to the law grounded on reason ... and it should relate to the State. Laws are necessarily good in pure governments as well as they are vicious in corrupt governments" La filosofía del Estado y su tridimensionalidad constitutiva clásica se fundamentan en la jurisdicción territorial, la gobernabilidad y la población. Actualmente la soberanía constituye otro elemento de poder, de autonomía y de libre determinación del rango constitucional y de la identidad del Estado. La globalización, como fenómeno, emerge quebrantando esos elementos constitucionales de la filosofía clásica y contemporánea del Estado, y se expande como poder transnacional, filtrado en las legislaciones y soberanías locales e instaurando un nuevo orden supraestatal a través de instrumentos globales o tratados de libre comercio. El sistema económico de los países del área y su constitucionalismo sojuzga esa hegemonía de soberanía global emergente que trasciende como soberanía supraestatal. De esto trata el presente documento.
