O DIREITO AO DESENVOLVIMENTO SUSTENTÁVEL NAS CIDADES BRASILEIRAS: UM ESTUDO DO CASO DE PORTO ALEGRE.THE RIGHT TO A SUSTAINABLE DEVELOPMENT IN BRAZILIAN CITIES: A CASE STUDY OF PORTO ALEGRE.Data da submissão: 01/05/2020Data da aprovação: 11/05/2020Resumo: Este trabalho visa apresentar uma evolução histórica e conceitual do Desenvolvimento Sustentável, bem como as formas que legislação brasileira defende o direito ao Desenvolvimento Sustentável e à Cidade Sustentável. Após, estudará a edição da legislação urbanística brasileira e a introdução do direito ao Desenvolvimento Sustentável na Constituição Federal e do direito à Cidade Sustentável na Lei Federal 10.257/2001 – Estatuto da Cidade. Finalmente, analisará os instrumentos que esse estatuto disponibilizou para a Administração Pública proteger tais direitos dos cidadãos, verificando como eram aplicados na cidade de Porto Alegre. O objeto desta pesquisa foi o Desenvolvimento Sustentável urbano. Seu objetivo foi demonstrar como tal conceito foi construído, e como ele se aplica no contexto brasileiro. Ela teve como metodologia a revisão bibliográfica, a análise de documentos, bem como o estudo de caso da cidade de Porto Alegre. Os resultados encontrados foram que existem mecanismos práticos aplicados nesta cidade que efetivamente auxiliam na implementação da sustentabilidade urbana, concluindo-se que Porto Alegre é um caso precursor de sucesso, mas ainda há a necessidade de expansão destas medidas a outros Municípios brasileiros.Palavras-chave: Desenvolvimento Sustentável; Função Social da Propriedade Urbana; Cidade Sustentável; Meio Ambiente Urbano; Porto Alegre.Abstract: This paper presents a historical and conceptual evolution of the Sustainable Development Concept, as well as the ways that Brazilian legislation advocates for the right of Sustainable Development and for a Sustainable City. The paper will also study the edition of the Brazilian urban legislation and the introduction of the right to Sustainable Development in the Federal Constitution and the right to a Sustainable City in the Federal Law 10.257/2001. Finally, it will analyze the instruments that this law provides to the Public Administration to protect such citizen’s rights, verifying how they were applied in the city of Porto Alegre. The main object of this research was the urban Sustainable Development. Its objective was to demonstrate how this concept was constructed, and how it applies in the Brazilian context. The applied methodology was the bibliographic review, document analysis, as well as the case study of Porto Alegre. The results found were that there are practical mechanisms applied in this city that effectively assist in the implementation of urban sustainability, concluding that Porto Alegre is a precursor case of success, but there is still a need to expand these mechanisms to other Brazilian cities.Keywords: Sustainable Development; Social Function of the Urban Property; Sustainable City; Environment; Urban Legislation; Porto Alegre.
