Las Causales de Exoneración de la Responsabilidad del Estado Frente al Estado de Necesidad.

Abstract

The present work considers if within the legal context and the Colombian local regulations regarding the broad tort regime of the State, in relation to the causes of exoneration, ¿Is the State of Necessity objectively observed? which will also determine if is considered against the causes of defense of responsibility. All this, making a study and emphasis on each of the grounds for exoneration based on the Jurisprudence and Colombian regulations, the advancement of the concept of responsibility from its origins in France until its arrival in the national legal system, observing the feasibility of relating the different causes of exoneration of responsibility, in the understanding that the human being in the development of his life is exposed to different situations beyond his control that make him act contrary to law.
