El conflicto entre la presunción Pater Is Est del artículo 361° del C.C y la prueba biológica del ADN frente al derecho de identidad del hijo extramatrimonial de mujer casada
La presente investigación tiene como objetivo analizar la presunción de paternidad ―páter is est‖, contenido en el artículo 361 ° y siguiente del Código Civil. Así especialmente si la presunción de paternidad matrimonial viene vulnerando o no el derecho de identidad del hijo extramatrimonial de mujer casada, en el entendido, que esta figura jurídica arcaica viene estableciendo una paternidad automática, que solo puede ser discutida por el propio marido, limitando de esta manera al menor inquirir la paternidad de su padre biológico, así como al padre biológico a reconocerlo, sin tomarse en cuenta que en pleno siglo XXI la prueba biológica científica del ADN establece sin duda alguna el verdadero origen genético y/o identidad de todo ser humano, en este caso que nos compete de los hijos extramatrimoniales de mujer casada.
Para el desarrollo de la investigación dogmática jurídica empleamos la técnica del análisis documental y la bibliográfica, con sus instrumentos el análisis de contenido y las fichas textuales, de comentario, de resumen y críticas.
