El error judicial de los jueces penales en la concesión de beneficios penitenciarios (semilibertad) en los delitos contra la libertad sexual en el distrito judicial de Ayacucho

Abstract

La presente investigación tiene por objetivo informar a la comunidad jurídica y a la sociedad sobre los errores judiciales que incurren los Jueces penales al conceder indebidamente beneficios penitenciarios a aquellos que cometieron delitos contra la Libertad sexual. A fin de ilustrar sobre esta problemática se analiza sentencias donde se destituyen a Jueces penales del Distrito Judicial de Ayacucho por haber cometido errores judiciales en sus decisiones de conceder beneficios penitenciarios a sentenciados por delitos contra la Libertad Sexual cuando la ley N°28704, prohíbe dichos beneficios.

The present investigation has for objective to inform to the legal community and the society on the errors judicial actions that criminal judges commit in the concession of prison benefits, such as semi-liberty to those sentenced for crimes against sexual freedom. In order to illustrate this problem, sentences are analyzed where Criminal Judges of the Judicial District of Ayacucho are dismissed for having committed judicial errors in their decisions to grant penitentiary benefits to those sentenced for crimes against Sexual Freedom when Law No. 28704 prohibits such sentences.
