Los Errores Judiciales En Los Juzgados Penales De Chiclayo, Consecuencias Y Obligatoriedad Indemnizatoria Del Estado

Resumen
El tema de la responsabilidad del Estado ha pasado por diversas etapas, las cuales van desde la total irresponsabilidad, basado en el origen divino del poder del Rey, hasta las doctrinas modernas, que distinguen entre la responsabilidad tanto en su calidad de administrador, legislador y juez.
Podemos referirnos a tres claros motivos por los cuales, el Estado, está en la obligación de hacer de la acción indemnizatoria una activa realidad.
Por una razón de confianza en el Estado y la ley, el Estado en su función de administrar justicia debe garantizar con entereza la justicia que imparte, respetando plenamente los principios que hacen esto posible como el debido proceso y la presunción de inocencia.
Por tal razón, cuando el Estado, en cualquiera de sus actividades, daña a las personas, se debe a la existencia de una infracción a las normas que consagran dichos principios.
Por lo tanto el Estado, así como ocurre en el caso de los particulares, ha de responder por su actuar, sin embargo la proclamación de esta responsabilidad se ha mantenido solo en el plano teórico y la disposición que la contiene no es más que programática.
Si bien es cierto que en el tema de la responsabilidad han habido avances, en orden de hacer efectiva la de los funcionarios por su actuar doloso o culposo, la responsabilidad del Estado es un tema mucho mayor y al respecto nuestro ordenamiento ha sufrido un estancamiento.
El Estado, considerado más allá del gobierno de turno, se gana el respeto, la confianza y el apoyo de sus ciudadanos a través de un actuar impecable, que si bien no está libre de errores, los reconoce, los repara y se somete de manera cierta y eficaz a la Constitución y a las leyes.The issue of State responsibility has gone through various stages, ranging from total irresponsibility, based on the divine origin of the King's power, to modern doctrines, which distinguish between responsibility both as administrator, legislator and judge.
We can refer to three clear reasons why the State is obliged to make the compensation action an active reality.
For a reason of trust in the State and law, the State in its function of administering justice must guarantee with integrity the justice imparted, fully respecting the principles that make this possible such as due process and presumption of innocence.
For this reason, when the State, in any of its activities, harms the people, it is due to the existence of an infraction to the norms that consecrate those principles.
Therefore, the State, as it happens in the case of individuals, must respond for its action, however the proclamation of this responsibility has remained only on the theoretical level and the provision that contains it is nothing more than programmatic.
Although it is true that in the subject of responsibility there has been progress, in order to make effective that of civil servants for their willful or guilty acts, the responsibility of the State is a much greater subject and in this respect our system has suffered a stagnation.
The State, considered beyond the government of the moment, earns the respect, trust and support of its citizens through an impeccable act, that although it is not free from errors, recognizes them, repairs them and submits itself in a way Certain and effective to the Constitution and laws.
