Análisis sobre la legislatura sobre la prescripción de bienes y la relación con la funciones de la Superintendencia de Bienes Estatales en Chincha 2019

Abstract

Objective: Determine the analysis on the legislature on the prescription of assets and the relationship with the functions of the superintendency of state assets in Chincha 2019. Methodology: This research corresponds to the Basic Type design, because it studies the relationship of two significant variables in my thesis. We consider that it follows a non-experimental, descriptive correlational design. It is non-experimental because there is no manipulation of the independent variable. Results: it is found that 36% of respondents added to 17% totally agree and agree that the norm that constitutionally recognizes the Superintendency of State Assets, to oppose the processes of formalization of property via Notary, of holders Non-owners of unregistered properties in the province of Chincha violates the rights of the owners, there is an opposition of totally disagreeing in 9%, as well as 17% who disagree. Population: The selected population was 25 lawyers and individuals familiar with prescription processes and specialists from notaries. The type of sample is a census sample, where the sample is the entire population, that is, the 25 lawyers, defendants with prescription processes and specialists from notaries. Conclusion: The Opposition of the Superintendency of State Assets prevents the holders from registering the real property as theirs; consequently, they will only be recognized as possessors, generating this fact that there is no protection of their rights.
