Análisis del artículo IV del Tratado Antártico: mantención del statu quo y perspectivas a futuro

Abstract

El artículo IV del Tratado Antártico ha logrado equilibrar las distintas -y controversialesposiciones sobre el problema de las reclamaciones territoriales del continente antártico estableciendo un sistema en donde los Estados pueden cooperan pacíficamente en su administración. Sin embargo, aún existen desacuerdos en torno a si la redacción del artículo IV realmente soluciona el problema de fondo relacionado a las reclamaciones territoriales en el continente antártico, o si solamente se limita a “congelar” dicha controversia. Al realizar un análisis detallado del artículo IV del Tratado Antártico, en conjunto con los antecedentes histórico-políticos que permitieron su redacción, es posible argüir que su redacción ha permitido contener el problema de las reclamaciones territoriales, propiciando un ambiente de paz en el continente antártico en el corto y mediano plazo. Sin perjuicio de aquello, y considerando las problemáticas actuales que nos repercuten a nivel de la humanidad, la revisión de este Tratado -y en particular su artículo IV- podría producirse en un futuro

Article IV of the Antarctic Treaty has managed to balance the different -and controvertedpositions regarding the problem of territorial claims in the Antarctic continent, by establishing a system where States can cooperate peacefully in its administration. However, there are still disagreements concerning the wording of Article IV, some say it does solve the underlying problem of territorial claims in the Antarctic continent meanwhile for others, it merely "freezes" such controversy. A detailed analysis of Article IV of the Antarctic Treaty, together with the historical and political background that led to its drafting, shows that its wording has made it possible to contain the problem of territorial claims, fostering an atmosphere of peace on the Antarctic continent in the short and medium term. Notwithstanding this and considering the current problems that affect us at the human level, the revision of this Treaty - and in particular, its Article IV – could happen in the future
