Resumen
Introducción: El interés superior del niño es un principio inspirador y fundamental sobre
los derechos de los que son titulares los menores, que posee un propósito protector sobre
estos debido a su particular vulnerabilidad a causa de la incapacidad que tienen de orientar su
vida con total autonomía. Objetivo general: Determinar si en las decisiones judiciales sobre
tenencia existe una transgresión al principio del interés superior de los niños, niñas y
adolescentes. Metodología: Enfoque cuantitativo-cualitativo, no experimental, documental,
descriptiva y de campo. Resultados: De la encuesta realizada a abogados en el libre ejercicio
el 15% considera que siempre se transgrede el Interés Superior del niño en los procesos de
tenencia al no ser escuchados, por otro lado, el 35,6% considera que siempre se transgrede el
interés superior, mientras que 46%1 considera que sucede ocasionalmente. Conclusión: Se
determinó que existe una transgresión a el Principio del Interés Superior del Niño debido a
ciertas decisiones judiciales en los procesos de tenencia en los que no se escucha a los niños
desde los 8 años involucrados en los procesos. Introduction: The best interest of the child is an inspiring and fundamental principle on

always violated in the custody processes by not being heard, on the other hand, 35.6% consider
that the interest is always violated. superior, while 46%1 consider that it happens occasionally.
Conclusion: It was determined that there is a violation of the Principle of the Best Interests of
the Child due to certain judicial decisions in custody processes in which children from the age of
8 involved in the processes are not heard.
