Resumen
En el presente trabajo investigativo abordaré el tema sobre Impugnación de la
Paternidad Voluntaria y sus consecuencias jurídicas por los vicios del
consentimiento. En Nuestra Norma Suprema la Constitución de la República del
Ecuador, reconoce a los diferentes tipos de familia que en la actualidad existen
por los diversos estragos dentro la institución familiar mismo que hace las
afectaciones en el entorno siendo estos el conyugal, paternal y al filial. La
Legislación Civil hace distinción sobre los hijos siendo estos legítimos,
legitimados e ilegítimos, mismos que pueden ser verificado por la presunción de
haber nacido dentro del matrimonio, por un reconocimiento voluntario o también
por una declaración siendo esta judicial. Debido a esto es importante efectuar un
análisis con a los vicios de voluntad para poder interponer la nulidad del
reconocimiento si dicho acto no tiene la condición de voluntario tiene vicio o con
causa u objeto ilícito. El Tribunal de la Corte Nacional dentro de un Ratio
Decidendi, considera que el reconocimiento voluntario sea este por el padre o la
madre es irrevocable donde se observa el reconocimiento voluntario, pero no se
toma en cuenta los vicios del consentimiento siendo estos error, fuerza y dolo.
Hemos observado en diferentes veredictos donde indica que no procede la
impugnación de reconocimiento voluntario, por quien ocupó la calidad de padre
o madre. Por medio de este trabajo analizaremos que las diferentes causas que
tiene el reconociente son legales. In the present investigative work, I will address the issue of Contesting
Voluntary Paternity and its legal consequences due to the vices of consent. In
Our Supreme Norm, the Constitution of the Republic of Ecuador, recognizes the
different types of family that currently exist due to the various ravages within the
family institution itself that affects the environment, these being the conjugal,
paternal, and subsidiary. The Civil Legislation distinguishes between children
being legitimate, legitimized, and illegitimate, which can be verified by the
presumption of having been born in wedlock, by a voluntary recognition or also
by a declaration being judicial. Due to this, it is important to carry out an analysis
with the vices of will to be able to file the annulment of the recognition if said act
does not have the condition of voluntary, has a vice or with an illicit cause or
object. The Court of the National Court within a Ratio Decidendi, considers that
the voluntary acknowledgment, whether by the father or the mother, is irrevocable
where the voluntary acknowledgment is observed, but the vices of consent are
not considered, these being error, force, and fraud We have observed in different
verdicts where it indicates that the challenge of voluntary recognition, by who held
the capacity of father or mother, does not proceed. Through this work we will
analyze that the different causes that the recognizer has are legal.
