The right of pregnant woman that is manifested in our Constitution of the Republic of Ecuador
constitutes a legal paradigm insofar as it is not regulated in the Organic Code of Childhood and
Adolescence specifically for the alleged parents who do not have the opportunity to prove
otherwise until perform a DNA test to demonstrate in a biological scientific way the parent-child
relationship, this cannot be possible until the child was born and after a year as stated in the Organic
Code of Childhood and Adolescence, within the present investigation We intend to demonstrate
the need to compensate in some way for the damage caused by the biological negativity of the
alleged father, making it clear that the impact on moral, patrimony and psychological damage is
insurmountable, much less if this alleged father already has a family. We can find that there has
not been much research on this topic despite the fact that the Organic Code for Children and
Adolescents was last modified in 2021.
