Análisis de la aplicación del delito de femicidio mediante sentencia N.-11282-2018-00641 , en la práctica penal ecuatoriana.

Abstract

La presente investigación es un estudio de la aplicación del delito de femicidio en la práctica penal ecuatoriana , para su desarrollo se eligió un caso dirigido a una sentencia que muestre la ruta , que debe seguir la persona que cometa tal acción y a la vez conocer los mecanismos que emplea el sistema judicial para condenarlo. La sentencia nos abre la puerta para conocer todo lo que engloba al femicidio , ya que constara todos los elementos que surgen para su juzgamiento, por eso en el caso práctico tenemos que el procesado acabo con la vida de su conviviente, bajo una relación de poder manifestadas en diferentes tipos de violencias que afectaron su ser. La violencia de género que vivió la víctima muestra que contiene unos niveles altos que en la práctica , se los mide a través de la convivencia vivida con su pareja y tales podemos mencionar , que serían tanto físicas , psicológicas e incluso depender económicamente de parte de él . Los nexos de esta investigación , contendrá que aparte del femicidio ocurre otro delito llamado asesinato , que fue cometido contra el hijo de ella , por eso tendremos la presencia del concurso de infracciones , mediante indagaciones en la sentencia observaremos al concurso ideal o real , todo esto para que exista un sentido más amplio en nuestro tema de caso.

The present investigation is based, on the study of the application of the crime of femicide in the Ecuadorian criminal practice, which for its development a case study was chosen, directed to a sentence that shows the route that the person who commits such a crime must follow action, and at the same time know the mechanisms used by the judicial system to convict him. The sentence opens the door for us to know everything that encompasses femicide, since it contains all the elements that arise for its judgment, that is why in the practical case, we have that the defendant ended the life of his cohabitant, under a relationship of power manifested in different types of violence that affected their being. The gender violence experienced by the victim shows that it contains high levels, which in practice are measured through the coexistence lived with her partner and such we can mention, which would be both physical, psychological and even financially dependent on the part of the victim. of him. The links of this investigation will contain that apart from the femicide, there is another crime called murder, which was committed against her son, that is why we will have the presence of the contest of infractions, which through inquiries in the sentence we will observe the idea or real contest, all this so that there is a broader sense in our subject matter.
