Propuesta jurídica ante la mala aplicación de la Norma Constitucional, vulnerando el debido proceso en las actuaciones judiciales

Abstract

El presente trabajo titulado “Propuesta Jurídica Ante La Mala Aplicación De La Norma Constitucional, Vulnerando El Debido Proceso En Las Actuaciones Judiciales” busca plasmar y regir basándonos a nuestro ordenamiento jurídico, donde se establecen reglas de carácter obligatorio, teniendo como meta que los derechos de las personas sean respetados y de la misma forma sean de obligatorio cumplimiento. Debemos considerar que la motivación como Derecho Constitucional y en relación con las Garantías del Debido Proceso, reconocido y protegido en la Constitución de la Republica del Ecuador, se deben aplicar de carácter obligatorio, aparte de que toda persona puede exigir y de otra forma las autoridades si no la aplican acarrea la nulidad del acto y la imposición de una sanción al incumplidor. El tenor literal de la norma da una carga de responsabilidad como obligación, cuando indica que los actos administrativos, resoluciones o fallos que no se encuentren motivados serán nulos. La finalidad de la DEBIDA MOTIVACION se entiende como un principio constitucional inspirador, para que la administración de justicia tenga realce tanto profesional, imparcial, rectitud y sobre todo la verdad del proceso. Enfatizando de que toda autoridad administrativa o judicial actué a la orden expresa de la Constitución.

The present work entitled "Legal Proposal Faced with the Misuse of the Constitutional Norm, Violating Due Process in Judicial Actions" seeks to shape and govern based on our legal system, where mandatory rules are established, having as a goal that the rights of people are respected and in the same way are mandatory. We must consider that the motivation as Constitutional Right and in relation to the Guarantees of Due Process, recognized and protected in the Constitution of the Republic of Ecuador, must be applied on a mandatory basis, apart from the fact that every person can demand and otherwise the authorities if they do not apply it, it entails the nullity of the act and the imposition of a sanction on the noncompliant. The literal wording of the standard gives a burden of responsibility as an obligation, when it indicates that administrative acts, resolutions or rulings that are not motivated will be null. The purpose of DUE MOTIVATION is understood as an inspiring constitutional principle, so that the administration of justice has both professional, impartial, rectitude and above all the truth of the process. Emphasizing that all administrative or judicial authorities act according to the express order of the Constitution.
