Los nuevos dueños que reciban bienes a título gratuito, tendrán que cancelar el impuesto a la renta sobre la herencia, legados y donaciones, el hecho generador, se da por tres motivos diferentes; herencia es cuando la persona dejó de existir, los nuevos dueños cancelan los impuestos, si es que pasa la base imponible. En segundo lugar, legados, este es cuando ambas partes deciden sobre una fracción del bien, uno cede y el otro recibe antes de fe pública ante el notario público del cantón donde está la propiedad, debe cancelar los impuestos. Y en última instancia, las donaciones, sobre esta, el donante decide ceder partes o la totalidad de sus bienes, se realiza en vida a familiares o a terceras personas, ambos deben acudir a la notaría del cantón que le corresponde, el notario antes de dar fe pública en el hecho generado, y es de voluntad propia; deberán cancelar los correspondientes tributos. El objetivo principal de la investigación se orientó a determinar el impacto del impuesto a las rentas sobre ingresos que provienen de las herencias, legados y donaciones, en la recaudación tributaria, con lugar en la ciudad de Guayaquil durante el período 2013-2018. La base metodológica fue administrada por servicios de renta interna, la cual se expresa en una investigación documental, de carácter descriptivo. Se destaca dentro del análisis que, la recaudación de impuestos para el Estado y poder invertir en los sectores que más lo necesitan. Según lo investigado sobre la recaudación, al país si le benefició el cambio de la tributación, esto debido a que, el gobierno en el año 2008 implementó la tabla, en el art. 36 de la Ley Orgánica de Régimen Tributario Interno (LORTI), creando una hipótesis positiva, en especial en las Ciudades de Quito, Cuenca y Guayaquil, cantones con mayores recaudaciones. The main objective of the research was oriented to determine the impact of the income tax on income that comes from inheritances, bequests and donations, in tax collection, taking place in the city of Guayaquil during the period 2013-2018. The methodological base was administered by internal income services, which is expressed in a descriptive documentary research. It stands out within the analysis that, the collection of taxes for the State and being able to invest in the sectors that need it most. According to what was investigated on the collection, the country did benefit from the change in taxation, this because the government in 2008 implemented the table, in art. 36 of the Organic Law of Internal Tax Regime (LORTI), creating a positive hypothesis, especially in the cities of Quito, Cuenca and Guayaquil, cantons with the highest collections.
