La protección y protocolización del area adyacente a la zona económica exclusiva insular de Ecuador

Abstract

El presente estudio tuvo como objetivo general precisar los mecanismos para la protección del área adyacente a la Zona Económica Exclusiva, haciendo referencia a los actos de pesca indiscriminada de las embarcaciones pesqueras extranjeras en los alrededores de la soberanía ecuatoriana reconocida por la Comunidad Internacional. Por medio de este trabajo de investigación queremos demostrar la importancia de esta zona, indicar también como el Estado ribereño tiene los siguientes derechos: a) de soberanía para la exploración y explotación; conservación y administración de los recursos naturales vivos y no vivos de las aguas supra yacentes; y, otras actividades para la exploración y explotación económica y la producción de energía derivada del agua de las corrientes y de los vientos; b) jurisdicción para el establecimiento y utilización de islas artificiales, instalaciones y estructuras; investigación científica marina; y, protección y conservación del medio marino. Se utilizó una metodología que consta con un diseño de Investigación Documental y un tipo de investigación de carácter Cualitativo, aplicando el método Histórico, Inductivo, Descriptivo y Exegético. Se realizaron entrevistas a personas especialistas que tuvieran conocimiento de la pesca indiscriminada en Alta mar porque esta actividad trae consigo varios efectos nocivos para el ser humano. Podemos expresar que Ecuador tiene 2 años para solicitar la ampliación de la plataforma continental por lo que debería hacerla y expandirla hasta 350 millas; y una vez que tenga jurisdicción en aquellas aguas que eran de Alta mar, se proceda a implementar ciertos artículos que están dentro de esta propuesta para imponer sanciones más graves porque no solo afectan a las especies marinas, sino también a todo el ecosistema marino por ese efecto depredador.

The general objective of this study was to specify the mechanisms for the protection of the area adjacent to the Exclusive Economic Zone, referring to the acts of indiscriminate fishing by foreign fishing vessels in the surroundings of the Ecuadorian sovereignty recognized by the International Community. Through this research work we want to demonstrate the importance of this area, also indicate how the coastal State has the following rights: a) sovereignty for exploration and exploitation; conservation and administration of the living and nonliving natural resources of the supra-recumbent waters; and, other activities for the exploration and economic exploitation and the production of energy derived from water from currents and winds; b) jurisdiction for the establishment and use of artificial islands, facilities and structures; marine scientific research; and, protection and conservation of the marine environment. A methodology that consists of a Documentary Research design and a type of qualitative research was used, applying the Historical, Inductive, Descriptive and Exegetical method. Interviews were conducted with specialists who had knowledge of indiscriminate fishing in the high seas because this activity brings with it several harmful effects for humans. We can express that Ecuador has 2 years to request the expansion of the continental shelf, so it should do it and expand it up to 350 miles; and once it has jurisdiction in those waters that were from the high seas, it proceeds to implement certain articles that are within this proposal to impose more serious sanctions because they not only affect marine species, but also the entire marine ecosystem for that reason predatory effect.
