Conveniencia en la incorporación de la prestación voluntaria de alimentos en el Código de la Niñez y la Adolescencia y el Código Orgánico General de Procesos

Abstract

Este trabajo trata sobre la importancia de la posibilidad que un progenitor pueda prestar alimentos voluntariamente utilizando el aparato judicial, para poder dejar constancia de su voluntad de cumplir de forma efectiva su deber de progenitor; analizaremos la figura de la Consignación Voluntaria de Alimentos, desde el punto de vista doctrinario, legal y social; su aplicación en los juzgados de la niñez y adolescencia, hasta la aparición del Código Orgánico General de Procesos. Se ha investigado, porqué se ha considerado improcedente esta figura, una vez que entró en vigencia el COGEP, realizando un análisis comparativo de la figura civil del Pago por Consignación y la inaplicación de ésta en el Derecho de Familia. Finalmente, se propondrá un proyecto de ley que haría viable la prestación de alimentos de forma voluntaria, contemplándose una reforma en el Código Orgánico de la Niñez y Adolescencia e incorporando su procedimiento en el COGEP.

This work is about the importance of the possibility that a parent can voluntarily provide food using the judicial apparatus, to be able to record their willingness to effectively fulfill their parental duty; we will analyze the figure of the Voluntary Consignment of Food, from the doctrinal, legal and social point of view; its application in the courts of childhood and adolescence, until the appearance of the General Organic Code of Processes. It has been investigated, why this figure has been considered inadmissible, once the COGEP entered into force, carrying out a comparative analysis of the civil figure of the Payment for Consignment and the inapplication of this in Family Law. Finally, a bill will be proposed that would make viable the provision of food voluntarily, contemplating a reform in the Organic Code of Children and Adolescents and incorporating its procedure in the COGEP.
