With the following investigation, the authors attempts to prove the serious problems generated by the application of the leading case agreement N° 02-2018/TCE, given that previous case laws are used to guarantee the principles of predictability or impartiality; however, the case subject to this research performs an extensive legal interpretation concerning the filing of inaccurate information, act that results in a clear contravention to the principle of legality.Con la presente investigación, los autores buscan poner en evidencia los graves problemas que genera la aplicación del Acuerdo de Sala Plena N° 02-2018/TCE, ya que, si bien los precedentes administrativos de observancia obligatoria tienen como principal finalidad garantizar los principios de predictibilidad o imparcialidad, el precedente objeto de estudio, al realizar una interpretación extensiva del tipo legal referido a la presentación de información inexacta, constituye una clara contravención al principio de tipicidad.
