dc.descriptionOne of the main legal controversies regarding criminal policies is about the expansion of criminal law to new fields such as environmental law and the economic order. The expected enactment of a new Criminal Code makes it necessary to determine the criminal policy principles that shall be applied to the protection of economic interests. The study of comparative law is of great importance on this matter. Article 294 of the Criminal Code of Spain is used by the author as an example of an abusive use of criminal law because it punishes conducts that, according to the ultima ratio and the minimal intervention principles, should received only administrative sanctions.en-US
dc.descriptionUno de los principales debates dogmáticos y político-criminales versa sobre la expansión del Derecho penal a nuevos ámbitos de protección como son el medio ambiente y el orden económico. Ante el futuro y esperado nuevo Código penal chileno resulta necesario comenzar a definir sus criterios político-criminales para la protección de los bienes jurídicos e intereses de contenido económico, donde los estudios de Derecho comparado resultan de vital importancia para su consecución. Así, el art. 294 CP español ha sido puesto como un ejemplo de extralimitación del Derecho penal al castigar conductas que, conforme con los principios de ultima ratio y de intervención mínima, deberían sancionarse exclusivamente en el Derecho sancionador administrativo.es-ES
