Alleged consent as an underlying justification in criminal law is an extremely controversial topic. Its circumstances are usually not associated with special or ingenious offenders but, instead, with citizens performing neutral and sometimes convenient social actions. Alleged consent is typically associated with property in threat, that can only be spared by disposing of some other property of same owner, who in the event is not able to decide about what means to deploy or even if action should be taken at all.El Consentimiento Presunto es una causal de justificación desarrollada en un ámbito temático sumamente controvertido. En su esfera de acción no se encuentran especiales e imaginativos infractores de la ley, sino ciudadanos que ejecutan acciones socialmente neutrales o incluso oportunamente necesarias. Para los casos en que se tipifica el Consentimiento Presunto, es característica el evento en que un bien jurídico amenazado que solo puede ser conservado a costa de otro bien jurídico del mismo propietario, en circunstancias en que su titular no está en condiciones de decidir con cuáles medios, o si a ese respecto, en realidad cabe acción alguna.
