O reconhecimento de uniões estáveis simultâneas à luz da boa-fé

Abstract

O presente Trabalho de Conclusão de Curso objetiva analisar a possibilidade de reconhecimento de uniões estáveis simultâneas, notadamente à luz da boa-fé dos envolvidos na relação afetiva. Para tanto, serão abordados entendimentos doutrinários e jurisprudenciais, utilizando-se do método dedutivo para o deslinde da discussão. De forma a possibilitar a pesquisa, inicialmente será traçado o histórico da concepção de união estável e da própria família, principalmente nas últimas décadas no Brasil, além dos conceitos atribuídos por autores e demais estudiosos do tema. Em seguida, o estudo se dispõe a analisar o instituto da união estável no ordenamento jurídico brasileiro, transpassando pela legislação constitucional e infraconstitucional e seus respectivos desdobramentos na jurisprudência. Além disso, far-se-á uma análise pormenorizada dos elementos caracterizadores da união estável e, após, se estabelecerá a distinção entre a união estável e o concubinato. Na sequência, será definido o conceito de união estável putativa e examinada a aplicabilidade da boa-fé no Direito de Família. Por fim, se apreciará especificamente o reconhecimento de uniões estáveis simultâneas, sobretudo com base na boafé dos parceiros envolvidos romanticamente.

This final paper aims to analyze the possibility of recognizing simultaneous stable unions, in the light of the good faith of those involved in the affective relationship. Therefore, doctrinal and jurisprudential understandings will be approached, using the deductive method for the ending of the discussion. In order to make the research possible, initially the history of the concept of stable union and of the family itself will be considered, mainly in the last decades in Brazil, in addition to the concepts attributed by authors and other scholars around this theme. Then, the study sets out to analyze the institute of stable union in the brazilian legal system, going through constitutional and infraconstitutional legislation and its respective developments in the jurisprudence. Thus, a detailed analysis of the elements characterizing the stable union will be made and, afterwards, the distinction between the stable union and the concubinage will be established. Subsequently, the concept of putative stable union will be defined and the applicability of good faith in Family Law will be examined. Finally, the recognition of simultaneous stable unions will be specifically appreciated, mainly based on the good faith of the partners romantically involved.
