Determinação da responsabilidade civil pelo dano ambiental causado pela água de lastro: uma abordagem jurídica

Abstract

This research presents a theoretical-conceptual approach of the environmental damage, caused by the ballast water, with emphasis in the determination of the civil responsibility incident on marine professionals. It discusses the concepts of ballast water and its environmental impacts, as the existence of the responsibility for the capitain and shipowner as a result of the noncompliance of the legislation. Presents concepts of civil responsibility, historic and incidence about naval activity, and discuss the levels of responsibility for these professionals, and what gaps of the actual legislation.
