This work had as its theme the discussion held without the vote of condemnation as a means of inclusion, citizenship and valuation of rights. In terms of fundamentals, such problematic dialogues with legal aspects, but broad social spectrum. Legally, we can say that, except for provisional arrest, the individual serving a sentence does not enjoy citizenship in its political aspect, compared to establishing the Magna Cart in his art. 15, section III: "It is forbidden to forfeiture of political rights, the loss or suspension shall apply only in cases of: III - Criminal final conviction, as long as its effects." Thus, those who live collected to prisons, because penal sentence, suspended will have the fundamental constitutional right to vote or apply for the electoral process. Despite the legislation in their texts ensure citizenship for temporary prisoners through suffrage, the reality is not developed with the same effectiveness. Rather, what one finds is the denial of this prerogative. In this sense, the suspension of voting rights of the arrested person is provisionally sanctioned that violates the fundamental rights of the human person.
