The Fiscal Incentive in the Law Income Tax as a Tool for Economic Development
EL INCENTIVO FISCAL EN LA LEY DE IMPUESTO SOBRE RENTA COMO INSTRUMENTO PARA EL DESARROLLO DE LA ECONOMÍA

Resumen
The purpose of this investigation was to analyze the fiscal incentive as instrument toreactivate the Venezuelan economy. Theoretically I base in the constitutional regulation,Law of Income tax, his Regulation, the doctrinaire postulates of Belisario (2003),Sanmiguel (2006), between others. Methodologically it was typified as a documentary study, descriptive, and of field, by a mixed design not experimental transeccional. The fielddata, they were obtained by means of an interview with questions by answers of openedend. One concludes that the State has developed the regulation to stimulate the bothnational and international investment, providing them with a juridical stable and predictableframe. Likewise it establishes the tributary incentives, which juridical nature is in theConstitution Bolivarian Republic of Venezuela, and the Organic Tributary Code. In thesame order, in the article 14 of the Law of Income tax it establishes the subjects andactivities exempt from the payment of the tax. Of equal way in article 197 it authorizes theExecutive to grant exonerations. Between the sectors benefited with fiscal incentives theyfind the agriculturalist and the tourism. In agreement to the perception of tributary expertson the incentives it was possible to estimate that the grant of the same ones has not beena positive, since it is necessary to attract investments juridical and economic safety, any Isacrifice of the State in tributary matter one will not see paid if these elements do not exist.The fiscal incentives have not been sufficient to face the crisis that is living nowadaysthrough the country, it is possible to say that the investors have not showed interest toinvest, in consequence the sacrifice of the State is diluted and achieves the attainment ofthe aims for which were create El propósito de esta investigación fue analizar el incentivo fiscal como instrumento parareactivar la economía venezolana. Teóricamente se fundamentó en la normativaconstitucional, Ley de Impuesto Sobre la Renta, su Reglamento, los postuladosdoctrinarios de Belisario (2003), Sanmiguel (2006), entre otros. Metodológicamente setipificó como un estudio documental, descriptivo y de campo, con un diseño mixto noexperimental transeccional. Los datos de campo se obtuvieron mediante una entrevistacon preguntas con respuestas de final abierto. Se concluye que el Estado ha desarrolladola normativa para incentivar la inversión tanto nacional como internacional, proveyéndolesde un marco jurídico estable y previsible. Asimismo establece los incentivos tributarios,cuya naturaleza jurídica se encuentra en la Constitución de República BolivarianaVenezuela, y el Código Orgánico Tributario. En este mismo orden, en el artículo 14 de laLey de Impuesto Sobre la Renta establece los sujetos y actividades exentas del pago delimpuesto. De igual manera, en el artículo 197 faculta al Ejecutivo para otorgarexoneraciones. Entre los sectores beneficiados con incentivos fiscales se encuentran elagrícola y el turismo. De acuerdo a la percepción de expertos tributarios sobre losincentivos se pudo apreciar que el otorgamiento de los mismos no ha sido positivo, pueses necesario para atraer inversiones seguridad jurídica y económica, cualquier sacrificodel Estado en materia tributaria no se verá retribuido si no existen estos elementos. Losincentivos fiscales no han sido suficientes para enfrentar la crisis que está viviendoactualmente el país, se puede decir que los inversionistas no han mostrado interés parainvertir, en consecuencia el sacrificio del Estado se diluye y no logra la consecución de losobjetivos para los cuales se crearon.
