The article addresses the steps of Brazilian law in combating the failure to decide by the public administration. It then examines the tacit approval under the terms of the Economic Freedom Act and its Regulatory Decree. It addresses its explicit and implicit requirements, the hypothesis of prohibition, effects after the fictitious act and the question of the applicability of the institute to states and municipalities.O artigo aborda os passos do ordenamento brasileiro no combate à omissão de decidir da administração pública. Em seguida, examina a aprovação tácita nos termos previstos pela Lei de Liberdade Econômica e seu Decreto Regulamentar. Abordam-se seus requisitos explícitos e implícitos, as hipóteses de vedação, os efeitos posteriores ao ato fictício e a questão da aplicabilidade do instituto a estados e municípios.
