Emendas constitucionais em pontos de veto: uma análise do controle de constitucionalidade na CCJC e no STF

O trabalho busca discutir uma questão central ao processo de reforma normativa no Brasil: o controle de constitucionalidade de atos normativos constitucionais nas suas diferentes etapas. Assim, procurou-se entender e analisar como a Comissão de Constituição e Justiça da Câmara dos Deputados (CCJC) e o Supremo Tribunal Federal (STF) atuam, respectivamente, no controle de constitucionalidade de propostas de emenda à constituição e das emendas constitucionais resultantes. Para isso, a pesquisa respaldou-se na teoria sobre pontos de veto - que explica como determinadas instituições podem agir para bloquear mudanças constitucionais legislativas. Mais precisamente, o objetivo foi analisar a argumentação em cada uma dessas Instituições, com o objetivo de apresentar como agiram (i) o STF, quando julgando Ações Diretas de Inconstitucionalidade relativas a emendas constitucionais, e (ii) a CCJC, quando emitindo seus pareceres. Para isso, primeiramente, as manifestações de cada uma das instituições tiveram seus argumentados categorizados. Em seguida, os argumentos utilizados por CCJC e STF para o controle de constitucionalidade foram analisados comparativamente, com o objetivo de entender se as instituições utilizavam uma argumentação comum, ou se as autoridades utilizaram novas chaves argumentativas em cada uma das arenas de discussão de constitucionalidade. Como resultado, pude observar que os documentos provenientes da CCJC tendem a constantemente fazer referência aos documentos do STF, enquanto o contrário não acontece. Já com relação às principais categorias de argumentos utilizados, ambas as instituições têm como base importante (i) artigos constitucionais, (ii) princípios jurídicos e (iii) textos doutrinários. Por fim, vale destacar que, por mais que os tipos de argumentos tenha sido similar nas duas instituições, os temas trabalhados por CCJC e STF se mostraram, na maioria dos casos, distintos. This dissertation seeks to discuss a central issue to the process of normative reform in Brazil: the constitutional review of constitutional normative acts in their different stages. Thus, we seek to understand and analyze how the Constitution and Justice Commission of the Chamber of Deputies (CCJC) and the Federal Supreme Court (STF) act, respectively, in the constitutional review of constitutional amendments proposals and the resulting constitutional amendments. For this, there was a dialogue with the theory of veto points, which explains how certain institutions can act to block political changes. More precisely, More precisely, the objective was to analyze the arguments in each of these Institutions, in order to present how (i) the STF acted, when judging constitutional lawsuits (Ações Diretas de Inconstitucionalidade) regarding constitutional amendments, and (ii) the CCJC, when issuing its opinions, acted. For this, first, the decision statements of each of the institutions had their arguments categorized – through tables presented in an annex to this work. Then, the arguments used by CCJC and STF for the constitutional review were analyzed comparatively, in order to understand if the institutions used a common language, or if the authorities used new argumentative keys in each of the arenas of constitutionality discussion. As a result, I could observe that documents from the CCJC tend to constantly refer to STF documents, while the opposite does not happen. Regarding the main categories of arguments used, both institutions have as important basis (i) constitutional articles, (ii) legal principles and (iii) doctrinal texts. Finally, it is worth noting that, despite the fact that the basis of the arguments was similar in the two institutions, the themes dealt with by CCJC and STF were, in most cases, distinct.
