Política criminal em âmbito municipal: uma análise da produção legislativa da Câmara Municipal de São Paulo durante a 17ª legislatura

Abstract

Tomando como ponto de partida a ampliação do papel do município como gestor de políticas públicas a partir da década de 1970, processo conhecido como descentralização, e o fato da Constituição Federal ter atribuído ao Município papel bastante colateral no manejo da segurança pública (Art. 144 da CF/88), o presente trabalho busca investigar quais espécies de política criminal foram propostas pela Câmara Municipal de São Paulo no período 2017 – 2019, que corresponde aos três primeiros anos da 17ª legislatura (2017- 2019). Com o uso do método da Teorização Fundamentada nos Dados (TFD), foram analisados 162 projetos de lei e suas justificativas, protocolados no período, e proposta uma tipologia de formas de atuação em política criminal mobilizadas pelos parlamentares, concluindo-se preliminarmente que, apesar de não possuir competência legislativa para produzir leis penais, e nem atribuição constitucional para atuar prioritariamente na segurança pública, há produção legislativa substancial em política criminal sendo proposta em nível municipal.

Taking as a starting point the expansion of the role of the municipality as a manager of public policies from the 1970s onwards, a process known as decentralization, and the fact that the Federal Constitution has given the Municipality a very collateral role in the management of public security (Art. 144 of CF/88), the present work seeks to investigate which types of criminal policy were proposed by the São Paulo City Council in the period 2017 - 2019, which corresponds to the first three years of the 17th legislature (2017- 2020). Using the Grounded Theorization (TFD) method, 162 bills and their justifications were analyzed, and a typology of forms of action in criminal policy mobilized by parliamentarians was proposed, concluding preliminarily that, despite having no legislative competence to produce criminal laws, and no constitutional attribution to act primarily in public security, there is substantial legislative production in criminal policy being proposed at the municipal level.
