En esta investigación se ha reflexionado sobre la ineficiencia del Derecho, fundamentalmente a la tradicional concepción del Derecho como un monopolio donde el único soberano detentador de la facultad de crear y proveer normas jurídicas es el Estado, formulándonos la siguiente pregunta: ¿en qué medida la aplicación competitiva del Derecho generaría un Derecho más eficiente por causa de la reducción de los costos de transacción? Frente a la alternativa de solución de concebir y aplicar un Derecho como competencia, donde tomamos como base que no sólo existen las normas formales (leyes), sino también las fuentes informales o también llamadas normas extralegales, como fuentes alternativas proveedoras de normatividad, y comprender que las personas no deciden que norma respetar por el solo dicho del legislador, sino por la satisfacción de sus intereses según el personal análisis de costo - beneficio. Esta alternativa de solución última mencionada, está basada en la reducción de los costos de transacción. La presente investigación se realizó entre los años 2015 y 2016, estudio basado en doctrina autorizada, entrevistas a juristas y a emprendedores ambulantes, empresarios y empleados. Se aplicó metodológicamente dentro de la relación del Derecho y la Economía, el Análisis Económico del Derecho.
