RESUMEN
Este trabajo está basado en La modificación unilateral de contratos bancarios por parte de las Instituciones Financieras en el Perú, regulada por el artículo 5 de la Ley 28587. Este artículo otorga la potestad a las Instituciones Financieras para modificar unilateralmente el contrato, sin necesidad de
Comunicar a los consumidores, sino hasta después de realizada dicha modificación, dejando sólo la posibilidad de resolver el contrato, de no estar de acuerdo, más no la posibilidad de negociar la modificación o dejar el contrato tal cual como se firmó en un inicio.
De este modo se considera que el artículo 5 de la Ley 28587, afecta los derechos del consumidor peruano de servicios financieros porque contiene una inadecuada Regulación y otorga el ius variandi a las Instituciones Financieras, siendo así se estaría limitando la capacidad de elección y decisión del consumidor de servicios financieros. Así mismo se ha encontrado que el citado artículo confronta normas del Ordenamiento Jurídico vigente en materia de protección al consumidor las cuales no admiten la modificación unilateral en los contratos, tal es así que en la actualidad es considerado un método comercial coercitivo según el nuevo Código De Consumo.
Lo que se busca es dar alternativas de solución a este problema, por lo tanto se establecerán los resultados a lo que se ha llegado, del mismo modo las conclusiones y recomendaciones.
