Homosexuality and homosexual couples come under discussion for academics, theorists and legislators of the world. Currently there are two positions on the one hand those who agree to grant fundamental and social rights to homoafectivas couples and who does not. To get a suitable position of the subject we have studied different existing evidence of homosexual people since ancient times. Larger cultures of the ancient world characterized under a veil of mystique and religiosity, however some cultures changed position according to those in power restricting and punishing homoerotic practices. In Peru homosexuality has been known in the pre-Inca cultures. The Moche and Vicus cultures give example through their ceramic figurines and where you can see the male homoerotic practices among its inhabitants. Nowadays, homosexuality is not a favorable category of protection , even more over the years legislative pretensions to regulate and promote the gay community have been dismissed , many of them because of the stigma and discrimination that accentuated in conservative groups like the church . The Family as the natural and historical institution of mankind has not been easy to describe. To this day the concept of family has the characteristic variability , which is why many authors consider that it is not recommended the definition of family in the law of a country, because this is changeable according to the evolution of society. Under optimum found that different kinds of families, the most important regulated by the Peruvian legal system, however is the Homoafectiva Family which is totally helpless in Peru. At the International level, our country is considered as one of the most conservative to not regulate social situation of homosexuals, including denying them their unions protection and quality of family even though their relationships have all the features that heterosexual unions. Unlike what we live in Peru, other countries set the family to recognize as homoafectivas pairs is consistent with fundamental rights regulated by various international law instruments and more with the General Principles of Family Law, through which the maxim " family Protection " means any state should ensure that all types of families without distinction this legally regulated and protected.
