Resumen
El presente trabajo de investigación tiene por finalidad demostrar la deducibilidad
de los gastos por entrega de bienes en programas de Responsabilidad Social en
la determinación del Impuesto a la Renta, puesto que en la actualidad es un tema
que genera inquietud en las empresas que desarrollan en el ejercicio de sus
actividades políticas para mitigar el riesgo de posibles paralizaciones a manos de
la comunidad aledaña. Esta investigación es de tipo descriptiva - analítica y no
experimental, ya que no se manipularon las variables de investigación, dado que
se sustenta en la jurisprudencia emitida por los máximos órganos resolutivos en
materia tributaria y judicial. Asimismo tiene como población y muestra a las
empresas del sector minero que incurren en este tipo de gastos. De lo desarrollado
a lo largo de la investigación, los gastos por entrega de bienes en programas de
responsabilidad social sí son deducibles a efectos del impuesto a la renta, puesto
que permiten de manera indirecta mantener la fuente productora de renta de las
compañías, sin embargo, es recomendable incentivar una propuesta legislativa que
incorpore dentro de la Ley del Impuesto a la Renta los presuntos escenarios bajo
los que sería deducible dichos gastos. The purpose of this research work is to demonstrate the deductibility of expenses
for the delivery of goods in Social Responsibility programs in the determination of
Income Tax, since at present it is an issue that generates concern in companies
that develop in the exercise of their political activities to mitigate the risk of possible
stoppages at the hands of the surrounding community. This research is descriptive
- analytical and not experimental, since the research variables were not
manipulated, given that it is based on the jurisprudence issued by the highest
decision-making bodies in tax and judicial matters. It also has as a population and
shows the companies in the mining sector that incur this type of expense. From
what has been developed throughout the investigation, the expenses for the
delivery of goods in social responsibility programs are deductible for income tax
purposes, since they indirectly allow maintaining the companies' income-producing
source, however, it is advisable to encourage a legislative proposal that
incorporates into the Income Tax Law the presumed scenarios under which such
expenses would be deductible.
