Propuestas de mejora a una metodología de riesgo ambiental del organismo de evaluación y fiscalización ambiental (OEFA)

Abstract

Durante la actividad profesional se aplicó la “Metodología para la estimación de nivel de riesgo que genera el incumplimiento de las obligaciones fiscalizables” (MEROF) del Organismo de Evaluación y Fiscalización Ambiental del Perú (OEFA), en el marco de los Procesos Administrativos Sancionadores (PAS), obteniendo información de primera mano respecto a su aplicabilidad, importancia y limitaciones. A través de un Estudio de Caso, se describió, analizó y propusieron mejoras a la MEROF. La mayoría de estas fueron aplicadas de manera interna durante la actividad profesional. La implementación de las mejoras las propuestas otorgan mayor razonabilidad, predictibilidad, adecuada motivación, así como rigor técnico, a las decisiones tomadas en el marco de los PAS del OEFA.

During the professional activity, the "Methodology for estimating the level of risk generated by non-compliance with the auditable obligations" (MEROF) of the Peruvian Environmental Assessment and Enforcement Agency (OEFA) has been applied, within the framework of the Administrative Sanctioning Procedure (PAS), obtaining first-hand information regarding its applicability, importance and limitations. Through a Case Study, the MEROF was described, analyzed and improvements where proposed. Most of these were applied internally during professional activity. The implementation of the improvements the proposals grant greater reasonableness, predictability, adequate motivation, as well as technical rigor, to the decisions made within the framework of the PAS of the OEFA.
