This research work carries out an analysis of legislation compared, between the
Ecuadorian regulatory framework and countries such as: Colombia, Peru, and
Brazil. Regarding their public policies and regulatory policies that have allowed the
inclusion of waste pickers within their legislation. It’s so through the policies
achievements of other countries, with conditions similar to ours, various responses
have been built so that there are proposals for various ways to include waste
pickers within the chain of integral municipal solid waste management, and restore
their rights for the activity carried out as a public service that it provides to citizens.
The comparative, dogmatic and historical method has been used to know the
jurisprudence of other countries and to contrast with the Ecuadorian regulation.
The main results that have emerged from this investigative process, were that
Ecuadorian municipalities need to carry out a normative development through
municipal ordinance, under a circular economy approach which develops the
multiple responsibilities of the municipal decentralized autonomous governments,
granted in the regulations to the environmental law, seeking recognition of the
activity of waste pickers within the Ecuadorian municipalities.
