In a conservative society which as the Ecuadorian with the scope that the Law give the “De Facto” union and considered as a civil state and equate with the marriage, is very interesting to analyze this institution, this topic have so much interest and controversy because of “De Facto” union is a way of coexistence. This is an option for same gender couples to be together. “De Facto” union is a new and different way conform family into society.
Through this investigative work, I will analyze the legal rights that “De Facto” union generates in personal and patrimonial effects. It is important to known the personal situation of a couple, as well as the property. We will do a historical analysis of “De Facto” union, as well as the definitions and conceptual notions, the development and regulation of “De Facto” union in the Code of the Ecuadorian Law. We will know the ways of establishing and legalizing “De Facto” union and it´s personal law effects such as; “De Facto” union as a civil state, the situation of the children and the law of food. Patrimonial effects in “De Facto” union is subject of the capitulations, goods of society, dissolution and liquidation of the society of goods and the different forms to end “De Facto”union. We will analyze the conclutions and culminate with the recommendations. I hope that the present work will be useful and beneficial.
