Any right that is declared or recognized in the proceedings before the Judge must be fulfilled by the sentenced in order to ensure, in this way, the fundamental right to an effective judicial protection of the actor and to complete the entire judicial process. Through the execution stage, compliance with what is resolved by the Judge, or what is established in one of the enforcement titles, allows not only to guarantee the right to effective judicial protection, but also reinforces compliance with the objectives of the administration of Justice, endorse what is prescribed in the Constitution of the Republic and generates that the principle of legal security has a true validity.
The present research focuses on the execution stage, due to the fact that several changes have taken place with the implementation of the General Organic Code of Processes, changes that seek to modernize the process area with the objective of greater efficiency and effectiveness at the time to execute the obligations contained in the execution titles. When the new Adjective Code has been in force for a few months, it is necessary to review and study how it was structured in the repealed Code of Civil Procedure, since this knowledge allows us to warn, what changes have been made in the new Adjective Code. As well as its effects, to indicate whether or not it contributes to ensuring compliance with the obligations.
