The Superintendency of Companies in order to control, update and organize credit sales on October 10, 2013 issued resolution SC.DSC. G.13.011, in the same, issues the norms that regulate the sending of the information that the companies that are under the supervision and control of the Superintendency of Companies, must report to the Directorate of Public Data Registries. The companies that within their activities carry out credit sales with or without interest have the obligation to transfer up to the 10th of each month depending on the number of RUC, credit information, the which must be sent according to the procedure and regulations mentioned by the Superintendency of Companies, the minimum amount to report credit information will be 0.15 times the basic unified salary.
On January 1, 2018, the DINARDAP, ceased to be the entity in charge of receiving the Credit Data Registry, currently where credit information is transferred is to the Superintendency of Banks, this when the government of the Former President Lenin Moreno issued the Organic Law for the Reactivation of the Economy, Strengthening of Dollarization where in article 359 it mentions that to provide the credit reference service, the Superintendency of Banks will be in charge of the Registry of Credit Data. The Superintendency of Banks, in case of detecting any type of infraction in the credit information, will be in charge of notifying the Superintendency of Companies, which will issue sanctions to the company that committed the fault.
The procedure they must follow goes from registering the data in the credit template, it is found on the page Superintendency of Banks in the cadastre area, there you will also find the User Manual for Company Registration and Manual for Transfer Information, with respect to the template, the same account with information fields must be filled out as explained in the procedure, after registering the data in template, the document must be sent in text files with ANSI enconding, in PIPE character, once this is done the file must be compressed in ZIP format. To carry out the transfer of credit information, the regulations indicated in resolution SC.DSC. G.13.011 must be complied with and in the event that they are not complied with, the Superintendency of Companies will issue the respective sanctions depending on the seriousness of fault committed by the company.
