El derecho humano a la vivienda en México. Reconocimiento normativo y judicial. El caso de Morelia, Michoacán

Abstract

The right to adequate housing is a human right that protects a basic need for the human being, indispensable for a good, complete and dignified personal development, which must be guaranteed by the Mexican State. Since it is recognized in national legal systems and international commitments signed by Mexico. Throughout the following investigation, a complete analysis is made regarding how the State should guarantee this Human Right and how they have effectively guaranteed it. The right to adequate housing is located in the classification of social rights, so in certain cases it is necessary to grant certain benefits by the State, since in certain circumstances it is essential to support the most disadvantaged, that individual who by his own means he cannot access the indispensable goods for a dignified life. So sometimes actions that favor some over others are necessary. However, what they are looking for is the effective equality of the members of society. It is important to mention, the fact that most of the population does not have a decent place to live. However, the point of guaranteeing a decent home to the population is not precisely to grant a home-owned house, where appropriate, it is enough to guarantee the fact of living in a place worthy of itself. For which the State must take actions that facilitate people access to housing, which range from avoiding speculation, providing credits and subsidies, among others. Such actions should be directed primarily at the most vulnerable people. At this point, public statecraft plays a fundamental role since it is through them that the State plans the actions it will take. Therefore, it is essential that they start from a human rights approach that seeks greater protection and quality of life for people.

El derecho a la vivienda adecuada se trata de un derecho humano que protege una necesidad básica para el ser humano, indispensable para un buen desarrollo personal íntegro y digno, mismo que tiene que ser garantizado, por el Estado mexicano. Ya que se encuentra reconocido en ordenamientos jurídicos nacionales y compromisos internacionales suscritos por México. A lo largo de la siguiente investigación, se hace un análisis completo respecto de cómo el Estado debe garantizar este Derecho Humano y como ha efectivamente lo ha garantizado. El derecho a la vivienda adecuada se ubica en la clasificación de los derechos sociales, por lo cual en ciertos casos se necesita del otorgamiento de ciertas prestaciones por parte del Estado, ya que en determinadas circunstancias es indispensable apoyar al más desfavorecido, a aquel individuo que por sus propios medios no puede acceder a los bienes indispensables para la vida digna. Por lo que en ocasiones son necesarias acciones que favorecen a unos sobre otros. No obstante, lo que buscan es la igualdad efectiva de los miembros de la sociedad. Es importante mencionar, el hecho de que la mayor parte de la población no cuenta con un lugar digno donde habitar. Ahora bien, el punto de garantizar una vivienda digna a la población, no es precisamente otorga una casa habitación en propiedad, en su caso, basta con garantizar el hecho de habitar en un lugar digno de sí. Para lo cual el Estado debe de tomar acciones que faciliten a las personas el acceso a la vivienda, las cuales van desde evitar la especulación, facilitar créditos y subsidios, entre otros. Dichas acciones deben dirigirse principalmente a las personas más vulnerables.
