Elementos para una reforma político-constitucional

Abstract

The representativity in Mexico is one of the major subjects that has been raised constantly with the intention of bringing some ideas to reflect about if all the sectors that make up society are represented; However, in our position we believe that more than represented should be corroborated that their rights are really protected. In our country you can attest of the representativeness in the legislative, since we find representatives by the principle of majority but facing this we also find those who assume the position according to the principle of proportional representation. Thus, we believe that the purpose of this figure is basically to establish a kind of checks and balances against the abuses that could be committed as a result of the abuse of authority. In such a way that precisely the objective of this work is to know the reality of plurinominal deputations, their repercussions and, where appropriate, bring lines that outline a proposal to strengthen the operation of it, which is why a species must be reconsidered of regulation through a reform that meets the specific needs of an era, but coupled with this, it is also interesting to get acquainted with the literature and praxis that exists in other countries that have adopted a similar model and whose consequences are appropriate to society where it applies.

La representatividad en México es uno de los grandes temas que se ha planteado constantemente con la intensión de acercar algunas ideas para reflexionar sobre si realmente todos los sectores que componen a la sociedad se encuentran representados; sin embargo, en nuestra postura creemos que más que representados se debe corroborar que realmente sus derechos se encuentren protegidos. En nuestro país se puede dar fe de la representatividad en el poder legislativo, ya que encontramos representantes por el principio de mayoría, pero de cara a ello también encontramos a los que asumen el cargo conforme al principio de representación proporcional. Así, creemos que la finalidad de esta figura básicamente es para establecer una especie de frenos o contrapesos ante los abusos que se pudieran cometer producto del abuso de autoridad. De tal manera que precisamente el objetivo que tiene este trabajo es conocer la realidad de las diputaciones plurinominales, sus repercusiones y en su caso, acercar líneas que esquematicen una propuesta para fortalecer el funcionamiento de la misma, motivo por el cual se debe replantear una especie de regulación a través de una reforma que atienda las necesidades específicas de una época, pero aunado a ello, también resulta interesante allegarse de la literatura y praxis que se tiene en otros países que hayan adoptado algún modelo similar y cuyas consecuencias sean adecuadas a la sociedad en donde se aplica.
