dc.description.abstract | In Mexico, there is a unique labor regime, which is not even recognized as such and which violates the Mexican legislation itself and the Human Rights recognized by the international instruments signed by the Mexican State. This special regime or exception are the police bodies, who do not have the quality of workers or any of the rights inherent in that legal relationship. The Mexican courts have decided on the interpretation that there is an administrative relationship between the Mexican State and the police bodies, so there is no obligation to watch for the labor rights of the police elements. The above is not logically or legally congruent with reality, since the police provide services with all the characteristics of a labor relationship without being recognized as such. his outright violation of their Human Rights in labor matters is a total incongruity, since the State trains them and gives them the duty of keeping and watching the rights of an entire society, but at the same time discriminates against them and violates their rights for assuming that difficult task in their own hands. | |
dc.description.abstract | En México, existe un régimen laboral único, el cual ni siquiera es reconocido como tal y que atenta contra la misma legislación mexicana, así como contra los Derechos Humanos reconocidos por los instrumentos internacionales suscritos por el Estado Mexicano. Este régimen especial o de excepción son los cuerpos policiales, quienes no detentan la calidad de trabajadores ni ninguno de los derechos inherentes a esa relación jurídica. Los tribunales mexicanos han decidido por la interpretación de que existe una relación administrativa entre el Estado Mexicano y los policías, por lo que no existe obligación de salvaguardar derechos laborales de los elementos. Lo anterior, no es congruente material ni jurídicamente con la realidad, ya que los policías brindan servicios con todas las características de una relación laboral sin que sean reconocida como tal. Esta franca violación a sus Derechos Humanos en materia laboral es una total incongruencia, ya que el Estado les capacita y les entrega el cuidado de los derechos de toda una sociedad, pero a la vez los discrimina y se violan sus derechos por tomar en sus manos esa difícil tarea. | |
