This monograph aims to conduct a study on the liability of the State against the damage caused to third parties by law unconstitutional. For better development of the theme you want, use has been made of the deductive method supported in extensive bibliography related to the topic, involving reading and discussion of books, journal articles and other publications that have close relationship with the research objectives. The theoretical framework of this research focuses on constitutional principled basis, especially to its supremacy. Thus, to better develop the topic chosen is meant to expose the relevant issues surrounding the topic, since there are scholars who defend the irresponsibility of the State for damage caused to third parties arising from laws unconstitutional, while others maintain accountability of the federal entity responsible for editing the law unconstitutional. With the study developed can be seen that, as well as any damage they cause to the federal entity an individual, also coming from the damaging act unconstitutional law must be indemnified.
