dc.description.abstractThis paper presents an analysis of Brazilian and American legislation in the scope of public procurement, with a focus on public works. Initially, a historical retrospective of its origins and main changes in its texts over time is made, so that the texts in their current format could then be approached. Soon after, some data are presented that illustrate the results that both countries have been obtaining through these regulatory systems, with which it was possible to observe, through data from the Federal Court of Auditors and an American study, that Brazil has greater difficulties in being efficient in the application of public resources than the US government. Finally, a brief analysis was made of the new Bidding Law, Law 14.133/2021, to understand if it brings news that seek to correct the obstacles pointed out to such inefficiency
