As society evolves and the internet is increasingly present in everyday life, the Archives needed to adapt to new demands. Therefore, this research has the general objective of understand the applicability of the use of copyright for the access of digital document available on the websites of the Public State Records of the South and Southeast of Brazil in line with the ethical aspects of the archivist. The study is justified by the great dissemination of information through the internet, with digital collections being a resource of easy access to the public, which must be guided by the copyright. A basic, qualitative, exploratory and bibliographic research was carried out, using as methodological procedures the direct observation of the Archives' sites and sampling of the digital surrogate and or digital records for data collection. As a result, it was found that the document reproduction services can be improved in the archives to meet the intellectual property rights. In conclusion, the interdisciplinarity between the code of ethics of the archivists and the copyright, as well as Archival Science and Law, is essential to achieve the balance between open access and the guarantee of the author's rights, being an opportune moment for the archivist to participate in this subject, in view of the current debate on the modernization of copyright law in Brazil.
