dc.description.abstract | This paper aims to study whether the use of cyberactivist practices directly by workers, in the face of the crisis of trade unionism, enhances or weakens the strike movement. Within this panorama, the correctness and proposition of this research is justified, in the extend that the network society presented to humanity new ways of communicating and articulating, impacting society as a whole, including the collective right to work and giving strength to the crisis of trade unionism. For this reason, the emergence of the strike without a union, made possible by the new information and communication technologies, challenges the Brazilian legal system and also has an impact on the decisions of the Superior Labor Court. Therefore, in this research, the use of a deductive approach method has been chosen, starting, with the first chapter, under a more general aspect when demonstrating the union reconfiguration before the network society, presenting the challenges experienced in the world of work by the advent of the network society, passing through the history of unionism in the past and today and commenting on the causes and consequences of the crisis of union representation. In the second chapter, this research addresses the issue more specifically, through the articulated strike movement into libertarian cyberactivism, where the strike movement is studied within the legal system, and subsequently, the strike movement under the articulation of a new protagonist, outside the unions. Finally, it enters the matter of the 2018 truck drivers' strike to extract the occurrence of empowerment or disempowerment of rights. With this search, it was possible to conclude that the use of cyberactivist practices directly by the workers, in order to carry out a strike movement without the union command, despite the superficial appearance of potentiality, ends up weakening the movement as a whole. In terms of procedure method, the historical method was listed, insofar as at various points of the work it is necessary to rescue the emergence of the institutes to understand the theme as a whole. The comparative procedure method was also used, because there is a need for comparison between different legislations and different judgements to extract their similarities and differences; and also, it is used the monographic procedure method, because it is observed, in a particular way, the group of individuals involved in the truckers' strike in 2018 to obtain the results of this research. | |
