dc.description.abstractThe Commission on Roles and Positions Public office are required by law, of free appointment and dismissal, occupied majority by public employees belonging to the framework of the federal judiciary. The aim of this study was to formulate a critical analysis of calls FC's and CJ's, in particular on how discretionary access to them and their relationship with the cultural aspects of the organ, with the motivation and career satisfaction of justice; with people management and power relations, with the work processes and management functions, with the impersonality and the public interest in a democratic state. Aanalysing of the phenomena studied, we conclude be facing a system that does not favor the functional motivation and satisfaction, which strengthens authoritarian relations of internal power, violates the assumptions of the Democratic State Law and Public Administration and does not contribute to the functional qualification of the judicial career.
