dc.descriptionO trabalho versa sobre o direito à sexualidade das pessoas com deficiência mental ou intelectual à luz da Convenção sobre os Direitos das Pessoas com Deficiência. Ao longo do estudo foi realizada uma investigação bibliográfica e documental para verificar o arcabouço normativo de proteção dos direitos delas no Brasil e se observar se este direito é respeitado no país, em especial no tocante ao tipo penal de estupro de vulnerável. Houve, também, um levantamento de como o tema é tratado em outros países (no caso, Irlanda e França), a fim de se trazer novos olhares sobre o assunto. O objetivo da obra é entender os reflexos do modelo social em relação à sexualidade destas pessoas de modo amplo e, mais especificamente, averiguar se o crime de estupro de vulnerável está previsto em termos discriminatórios, de modo a tolher os direitos sexuais delas. Ao final, duas possíveis soluções são apresentadas (uma interpretativa e outra por meio de alteração legal) e se ressalta, tendo em mente o novo modelo de deficiência, a importância do amadurecimento da sociedade para que as pessoas com deficiência mental ou intelectual tenham os esclarecimentos suficientes para poderem se autodeterminar em relação à sua sexualidade.
dc.descriptionThe work is about the sexual rights of the intellectual or mental disabled people with the influence of the Convention on the Rights of Persons with Disabilities. During the study, it was accomplished a bibliographic and documental research to verify the normative framework for the protection of their rights in Brazil and to observe if this right is respected in the country, in special regarding to the crime of rape of vulnerable person. There was also a survey related to how the issue is treated in other countries (in this case, Ireland and France), in order to bring new views about the subject. The aim of this work is to understand the reflection of the social model in relation to the sexuality of these people in a broad way and, more specifically, investigate if the crime of rape of vulnerable people contains discriminatory terms, decreasing their sexual rights. In the end, two possible solutions are shown (one is interpretative and the other is through legal modification) and it is highlighted, having in mind the new social model, the importance of the ripeness of the society so that the people with mental or intellectual disability have enough information to have the ability to self-determinate regarding their sexuality.
